My 125 CRPC maintenance case has reached its conclusion, and I intended to appeal this decision in the High Court, but one of my crucial documents was not exhibited in family court. Will the high court now accept that same document—which was not exhibited—as proof? If not, how can I use that document, and what are my other options moving forward?(The document I am referring to is a generic income statement for my husband that I obtained from online RTI).

A.Dear Sir,
The procedure is you have to prefer appeal/revision against such concluded judgment. You have to take a contention before the High Court to remand the matter to the Lower Court to get receive and get mark such crucial documents and to pass fresh judgment taking into consideration such crucial documents.

A.Dear Client,

In the given situation, you can file a petition before the High Court praying for a review of the order passed by the Court under Sec.125 of CrPC mentioning the document left for consideration before the trial Court. Based on the merit in your appeal, HC may allow the review petition or may reject the petition bereft of any merit.
