whether the third party of insurance can claim insurance before consumer court ? if not then which court?

There is one office called Insurance Ombudsman. You must exhaust remedy by approaching the said office and thereafter you can go to Consumer Court.

Indian law recognizes the principle of privity of contract, and thus a third party would be unable to bring a direct claim against an insurer. However, it is common practice, for third parties to name the defendant’s insurer in motor accident claims-related proceedings. Further, in the absence of any reference to arbitration under the terms of a policy, insurance disputes can be litigated both before a civil court or consumer forum.
