A.Dear Sir,
There is one office called Insurance Ombudsman. You must exhaust remedy by approaching the said office and thereafter you can go to Consumer Court.

A.Dear Client,
Indian law recognizes the principle of privity of contract, and thus a third party would be unable to bring a direct claim against an insurer. However, it is common practice, for third parties to name the defendant’s insurer in motor accident claims-related proceedings. Further, in the absence of any reference to arbitration under the terms of a policy, insurance disputes can be litigated both before a civil court or consumer forum. If the insurer initiates the litigation before the Civil Courts, and Consumer Court cannot entertain such disputes. Reach out to an Advocate for guidance and steps.

A.Dear client,
Third party insurance is usually claimed either by registering an FIR and procedure from there onwards, or by registering it with the tribunal court in your jurisdiction
