Advancement petition to prepone a hearing date
10 months ago
Hi, I wanted to prepone my hearing date from July 14th 2023 to 30th June 2023 in Family case as i am going to abroad for a short period during second week of july. The respondent has been ex-partyed so i need not take the other party signature. Now my question is :
Apart from filing application in the family court , do i need to file affidavit as well or only filing an application will suffice.
A.Dear Sir/Madam,
Since it is ex-parte as such you can advance the case by filing two applications one under Section 151 of CPC along with your Affidavit and get it advanced. Further, you may have to file another application for the purpose for which it is being advanced.
