My employers have not given me gratuity.I worked in a private school in Thane for 35 years
A.Dear Client,
Once an employee render continuous service of five years under an employer or establishment irrespective of private or public, he or she became eligible for gratuity under the Payment of Gratuity Act, 1972. Since the nature of service rendered by a Teacher of an Educational institution comes under the purview of the Act, on cessation of employment for retirement/resignation putting continuous service of five years, he or she can claim gratuity from the employer u/s.4 of the PG Act and on denial of said claim, employee should file an application before the Controlling Authority and ALC of State Government under whose jurisdiction establishment falls praying for an order for payment of gratuity as per the provision of the PG Act, 1972.
