My mother was expired when i am 4 years old. After that my father got married again. When i become matured, my father and my stepmother throw me from the house, and told me that i have to right to stay in the house. After 2/3 years again i claim to stay in the house. But, they didn't allow me to stay there. When i said, that i will take legal help, my father sold the property, and took a new property in the name of my stepmother. Now, he is saying that this is her house legally. I can't stay there... Now what should i do??

A.Dear Client,
In the given situation, if the property sold by your father is his self-acquired property, then you got no claim on the said property as a matter of right. But in case the said property is ancestral property your father inherited the share of said ancestral property through the partition, then your father cannot dispose of the said property without the consent of other legal heirs who got right over the by birth. So to prove you right you have to find out the nature and class of property that was sold by your father to buy a new one. Reach out to an Advocate with relevant papers of property available with you for guidance and steps.

In that case, you got no claim on the said self-acquired property of your father.

A.Dear client,
Unfortunately unless the house that you originally lived in was your mothers', you have no legal right over that house. Even if it was your mother's, you will need legal help to prove that your father sold property that rightfully belonged to you.
