Couple with acontract for no cheating with additional conditions before marriage Couple with acontract for no cheating with additional conditions before marriage

Can my partner (Not a citizen of India) and I sign a mutual contract to be legally faithful to each other? Which would mean no cheating in any form along with some additional conditions that would give peace for both parties in the relationship when we are apart for jobs and everything before our marriage. A cohabitation agreement can be signed but it doesn't enforce faithfulness. Please tell me what is possible.

A.Hello Client,

In India, such agreement between life partners are considered invalid. Also, adultery is not punishable anymore. Though adultery can be a ground for divorce. In some Europe countries Prenuptial agreements are valid where such points can be added according to both parties wishes but in India, there is no legal value for the same.

Thanks & Regards

A.Hi client,

As in India marriage is a religious ceremony, such western concepts always are doubtful. Again under the Indian Contract Act,1872 it is a valid. So, you can opt for the same.

Is it valid enough to be applicable for adultery? Will it make cheating in the relationship (breaking the contract) a punishable offense?
