Legal heir certificate property

Hi, I applied legal heir certificate in court about my husbands self acquired property. My husband died we don't have childerens. 1year completed still court not decided who are legal heirs. One flat on my joint names on me and my husband. In this flat present my in laws are staying. Can I send notice to my in laws to vacate our flat? Because it is in court and that too court not decided who are legal heirs. I think it comes under litigation and I have more tights to stay in that flat. Please suggest me.
