my mother and my brother booked a flat with a reputed builder in Noida. They were allotted a flat in 2009. Thereafter my mother expired in 2019 intestate. I do not know the fate of the booked allotted flat. Sent a legal notice to the builder but he din respond. My terms with my brother are not smooth. what remedy do i have?

A.Dear Sir,
You have to dig into the matter and get more details then approach the builder or the Civil Court to exercise your rights.

A.Dear Client,
In case you can collect the papers of allotment of the Flat by the Builder which was jointly allocated to your mother and brother, you can escalate the matter before the RERA by filing a complaint against the Builder for a resolution in the matter. You being a legal heir of your deceased mother can also make a representation before the District Consumer Protection Council headed by Dist; Magistrate stating the non-cooperation of the Builder for a resolution in the matter.

A.Dear client,
You have exclusive rights along with your brother in that property. If you do not know if the flat was purchased by your mother, please file a suit in the civil court asking it to order investigation with regard to the same.
