A.Dear Client,
Compassionate Appointment is a social security scheme launched by the Government of India to grant appointment to a dependent family member on a compassionate basis when a Government servant dies while in service or retires on medical grounds applying the rules of die in harness. The mere death of a Government servant in harness does not entitle the family to claim compassionate appointment as a matter of right. There is no inherent right to seek compassionate appointment nor a dependent family member of the deceased government servant become automatically entitled to appointment; it is only a benefit provided by the State to overcome financial hardship. Compassionate appointment is allowed for Group ‘C’ or Group ‘D’ posts against the direct recruitment quota. The eligibility conditions for compassionate appointment under the Scheme circulated by the Deptt of Personnel and Training (DOPT), Govt of India are (a) The family is indigent and deserves immediate assistance for relief from financial destitution, and (b) the Applicant for compassionate appointment should be eligible and suitable for the post in all respects under the provisions of the relevant Recruitment Rules. Being the position as stated above, you may represent your case/grievance before the following authorities concerned, i.e, (a) Joint Secretary in charge of administration in the Ministry/Department concerned. (b) Head of the Department in the case of attached and subordinate offices. (c) Secretary in the Ministry/Department concerned in special types of cases. Until and unless strong proof of miscarriage of rules/laws appears on the face of record or appeal, Courts did not interfere in the matter of compassionate employment.

A.Dear client,
You should give a representation to the higher authorities and if they do not respond then file a case in the high court to get the job under the compassionate appointment category.
