EWS category flats in private builder high rise apartment complex can be purchased by anyone or only low income group? Builder is offering to sell the apartment to anyone. Is it ok?

A.Dear Client,
A residential flat built for sale to members of India's economically disadvantaged social groups falls under the EWS (economically weaker section) category. EWS apartments are reserved for persons who have never owned a home or apartment before. Government records list these apartments that are being sold at reduced prices. Therefore, use caution when purchasing such properties because they cannot be registered to a second buyer and cannot be refinanced. Prior to the year 2016, these apartments were sold based on super-built-up area, but since the implementation of RERA in 2016, apartments are only sold based on carpet area. Therefore, if the builder is marketing these apartments outside of the EWS category, you should complain.

A.Dear Client,
Residential flat in the EWS (economically weaker section category), is a flat constructed, to be sold to people from economically weaker section of the society, in India. EWS flats are meant only for those people who don't have any house/flat in past. Such flats, being sold at subsidised rates are on government records. So, beware before buying such properties, because these cannot be registered to second buyer and they aren't loanable for second time. Before the year 2016, these flats were sold out on basis of super-built-up area and after implementation of RERA in 2016, the flats are being solc on the basis is carpet area only. So if the Builder is selling these flats other than EWS category, then file a complaint against the Builder before RERA for necessary action.
