A.Dear Client,
From the contents of your query, it appears that you were dismissed/terminated from service for proven misconduct committed by you. So, when you are entitled to an experience certificate for the long service, and even your employer agreed to issue you said certificate that would invariably reflect the reason behind your separation from the service i.e, termination/dismissal from service on the ground of proven misconduct, which may not be useful or purposeful for any purpose. However, you can escalate your grievance before the concerned Labour Commissioner for a resolution in the matter.

A.Dear client,

Review Employment Contract and Policies: First, review your employment contract and the company's policies to understand the terms related to termination, relieving letters, and employee records. This will help you assess your rights and entitlements.

Document Communication: Keep records of all communication with the HR department regarding the relieving letter. This includes emails, messages, and any other forms of communication that indicate your request for the letter and the company's response.

Engage in Dialogue: Continue discussing the matter with the HR department or relevant authorities within the company. Explain the significance of the relieving letter for your future career opportunities and ask for a reconsideration of their decision.

Seek Legal Advice: If the company remains uncooperative, consider seeking legal advice from an employment lawyer or a labor consultant. They can review your case, advise you on your rights, and help you explore potential legal avenues to obtain the relieving letter.

Mediation: If direct communication and legal advice do not yield results, you can explore mediation as an alternative dispute resolution method. Mediation involves a neutral third party facilitating discussions between you and the company to find a resolution.

Labor Authority or Ombudsman: In some countries, there are labor authorities or ombudsman offices that deal with employment-related disputes. You can check if such a body exists in your region and seek their intervention if necessary.

Employment Verification Services: If all efforts fail to obtain the relieving letter, you can explore using employment verification services provided by third-party agencies. These services may help verify your work experience even without a relieving letter.
