Company not giving me my incentive. Delayed by 4 months Company not giving me my incentive. Delayed by 4 months

Hi, I work in a company as a business development executive in okhla. It's a service based company. We get an incentive at the end of the financial year if we achieve the target. Last financial year i accomplished my targets and over achieved it and I was promised for an incentive at the end of financial year which was 31st March,2023 but it's been almost 4 months and the managers not giving my incentive even after several follow ups on mail, face to face conversation ( I have the recordings) they are not giving me any satisfactory answer and keep delaying.
I am seeking for an help/opinion about what should I do in this case where should I complain if they refuse me to give incentive?

A.Dear Client,
If the contract of employment provides you with that benefit on the basis of your annual performance appraisal, then on achievement or good performance report you are definitely entitled to get that incentive from the Company. But the performance appraisal report of an employee is treated as confidential and the prerogative of the management to fix the target of achievement that is entitled to an employee for the benefit. Based on verbal assurance you cannot claim the benefit from the Company as a matter of right. If you possess sufficient proofs that support your claim for the incentives, then you may escalate the grievance before the higher authority of the Company failing which you may file an application before the concerned Labour Commissioner for redressal of your grievance.

A.Dear client,
Review your employment contract: First, review your employment contract or any relevant documents to confirm the terms and conditions regarding incentives, including the criteria for eligibility and the time frame for payment.

Document everything: Keep a record of all communications related to the incentive, including emails, face-to-face conversations, and any promises made by your managers. Having evidence like recordings can be helpful if you need to escalate the matter.

Follow up in writing: Send a formal written request to your managers, explaining the situation and reminding them of the incentive you were promised. Request a clear explanation for the delay and a timeline for when you can expect to receive the incentive.

Seek support from HR: If your managers are not responsive or do not provide a satisfactory resolution, escalate the matter to your HR department. HR is usually responsible for handling employee grievances and ensuring fair treatment.

File a complaint: If your HR department is unresponsive or does not resolve the issue, you can file a formal complaint with higher management or the company's grievance committee, if available.

Approach labor authorities: If all internal channels fail to resolve the matter, you may consider reaching out to labor authorities or relevant government bodies that oversee labor rights and disputes. In India, the labor commissioner or labor court might be able to assist you.

Seek legal advice: If the situation remains unresolved, consult with an employment lawyer who can provide legal guidance and advise you on the best course of action based on the specific details of your case.
