Flat purchase - BBMP Deviation in Building plan...safe to proceed Flat purchase - BBMP Deviation in Building plan...safe to proceed

Hello,

I am planning to purchase a flat in Uttarahalli Bangalore which comes in my budget limit.
The builder has submitted building plan in 2400 sq ft to BBMP for having g+3 one flat floor.(4 houses)
But actually in reality he has constructed 2 houses each floor(each 1200 sq ft) and a pent house. (9 houses)

The builder offers loan from LICHFL alone and not nationalized bank loan.
Is ok to purchase a single flat in this? Will i get issue in future?

A.Dear Client,
When deviation and mismatch between the approved building plan and constructed buildings appear on the face of the project, buying such property may put you in trouble in future apart from other legal consequences. In the given situation, you have to take a decision wisely considering all the future implications even the value of the property is affordable to you. You may consult with an Advocate for further clarification in this regard before your final decision.

A.Dear client,

Verify the building plan: Request a copy of the approved building plan from the builder or the BBMP. Compare it with the actual construction on the site to ascertain if there are any deviations. If there are significant discrepancies, it might indicate a violation of building regulations.

Check property documents: Thoroughly review all the property documents, including the sale agreement, title deed, and approvals obtained from the BBMP and other authorities. Ensure that the property has a clear and marketable title.

Engage a lawyer: It is crucial to consult with a property lawyer who is well-versed in real estate matters in Bangalore. The lawyer can scrutinize the documents, investigate any irregularities, and provide legal advice on the best course of action.

Verify loan eligibility: If you plan to take a home loan, ensure that the property is eligible for financing from the selected lender (LICHFL, in this case). Some lenders may have restrictions on financing properties with deviations from approved plans.

Check occupancy certificate: Verify whether the builder has obtained the necessary occupancy certificate for the completed construction. An occupancy certificate indicates that the building is compliant with the approved plans and is fit for occupancy.

Research builder's reputation: Conduct thorough research on the builder's reputation, previous projects, and track record. Look for reviews and feedback from other buyers to gauge their satisfaction with the builder's work.

Visit the site: Physically visit the property to assess its current condition and compare it with what was promised by the builder.

Consider alternatives: If you find any red flags or uncertainties regarding the property or the builder's actions, it might be wise to consider other properties that have a clear legal status and meet your requirements.
