My grandfather had bought a land and divided the land with his children's (5 children) as per their preference without writing any will but later one part of the land which was away from village and nearby highway which was alloted to my father gained value and when my grandfather passed away all his brother's turned their attention towards the highway land as it gained high value and was strategically important.
So will my father be able to claim the inheritance over the land which was alloted by my grandfather without any will.

A.Dear client,
In a self-acquired property, the father has the right to gift the property or will it to anyone he wishes and the children do not have any right in objecting the same. However, after the death of the father, if the father dies without a will, the self-acquired property is equally distributed amongst his legal heirs.
