A.Dear Sir,
If there is already pending complaint then you cannot lodge another complaint. If another complaint is lodged by some other person then you may become witness in such pending case.

A.Dear Client,
As a property owner and plaintiff in the pending complaint suit, you need to apply to the court, referring to Order 39 (rules 2 and 1) of CPC, to obtain a temporary injunction against the encroachment of land. The court will assess your application and request the defendant to file a reply to the injunction. If the court considers the injunction valid, it will pass an order for a temporary injunction on the concerned property. The court passes an ex-parte injunction if a defendant does not file a reply to the application or if the reply will cause a significant loss for the applicant. You can claim damages caused due to land encroachment. You may consult with your Advocate for further guidance and steps.

A.Dear client,
Ideally, you cannot file a second complaint when the first complaint is still pending in a court of law. Please wait till the disposal of the first complaint to take further legal action
