Hi team, please advice below.
Agreement was signed on 2nd August by both parties. Police verification was done on the same day. He paid Deposit on July 29 to show assurance and Paid rent on August 5. Though he had seen the flat multiple times before and hence agreed to even pay the deposit earlier to show his confirmation, on August 10 he decided he does not want to stay in the flat due to seeing cockroach. I had painted the flat as well for him on August 3 as he wanted the same. After cancelling the agreement I paid him back his deposit money out of good will but kept the rent as I had to find a new tenant. After getting a new tenant I made a new written agreement from September 1. Now my earlier tenant is threatening and calling me names and harassing that I should also return his rent back. Could you please advise the legal and right means here as my flat was vacant the entire August month due to him?

A.Dear Client,
If there is a clause in the rent agreement stating that in case of termination of the agreement both the parties inform each other with one-month advance notice, then if the tenant leaves the premises without serving one-month advance notice then for breach of said condition, a tenant cannot claim a refund of one month rent from the landlord. So, go through the terms and conditions of the rent agreement and ignore his claim referring to the specific terms of the agreement that disqualified/disentitled him from claiming the refund of one month's rent.
