The sales employees of Pharmaceuticals Company are governed by the Sales Promotion Employees(Condition of Services) Act, 1976, However, as per the provision of Sec.6(2) of the said Act, sales promotion employees of Pharmaceuticals Company can escalate their grievances against the Company under Industrial Dispute Act, 1947 considering the nature of work that comes under the purview of workmen as defined under Sec.2(s) of the I D Act, So, for any dispute as defined u/s.2(k) of the I D Act, the sales employees can represent their dispute/grievance against the Company through a registered trade union in which they member before the concerned Labour Commissioner of the State Govt.. Therefore, unauthorized deduction from salary and withholding of salary of employees which amounted to unfair labour practice as defined u/s.2(r) of the Act sales promotion employees can raise an industrial dispute before the appropriate authority as defined under Chapter II of the Act.
