Am guarantee for my brother loan. Borrower and bank hand shake and sold guaranteed property in e auction low price. Borrower property remains not sold. Because my commercial is very demand. I want to know any process to take STAY or to delay occupancy

A.Sear Sir,
Immediately go to Debt Recovery Tribunal and get a stay on such illegal E-auction of your property when property of the principal borrower not sold.

A.Dear client,
There is no way you can get the property back after it has been auctioned except if you can prove that the auction was not held in accordance with the law.
If you want to get stay order, then
Hire a lawyer and approach the court with an application requesting a stay order on your property.
Along with your application, attach documents such as property papers, identification proof, and FIR along with the application.
Mention the reason and nature of stay you are seeking.
