I am a widow. A couple gave their 5th child for adoption due to their poverty. I also want to adopt so will it be enough for me and the child's parents to prepare the adoption deed through a lawyer and register it in the sub registrar office?

A.Dear Client,

In India, adoption is primarily governed by the Hindu Adoption and Maintenance Act, 1956, and the Juvenile Justice (Care and Protection of Children) Act, 2015. Typically, a home study is conducted by a qualified social worker to assess the suitability of your home and family for adoption. This process helps ensure that the child's best interests are protected. Work with an adoption lawyer to prepare the necessary legal documentation, including an adoption deed or adoption agreement. This document should outline the consent of the biological parents, the details of the adoption, and the rights and responsibilities of all parties involved. The adoption deed, along with the consent of the biological parents, will likely need to be submitted to the court for approval. The court will review the case and ensure that all legal requirements are met. Once the court is satisfied that the adoption is in the child's best interests and all legal requirements are fulfilled, it will issue an adoption order. This order legally transfers the child's rights and responsibilities to you as the adoptive parent. After obtaining the adoption order, you should register it at the sub-registrar office or the appropriate government authority. This step is crucial to ensure the legal recognition of the adoption.
