Mistake in surname in share certificate Mistake in surname in share certificate

On my share certificate my husband’s surname is written as it was a common practice 40 years ago when Aadhar and pan card were not there. But later my Aadhar and pan were made with my maiden surname as per Date of birth certificate. There is no name change at all and I produced affidavit also stating the mistake. Yet RTA is insisting Gazette publication for name change. What can I do as deadline for Dematerialization is approaching?

A.Dear Client,

Gather any evidence you have of the correct surname, such as your marriage certificate or other official documents. It's a good step that you've already produced an affidavit stating that there has been no name change. Make sure that the affidavit is properly notarized and includes all relevant details, such as your maiden name, marriage date, and the incorrect name on the share certificate. Try to engage with the RTA (Registrar and Transfer Agent) again and explain your situation. Provide them with copies of your affidavit, marriage certificate, Aadhar, PAN card, and any other documents that can establish your identity and the correct surname. If it becomes necessary to publish a name change in the Gazette, consult a lawyer to initiate the process. This typically involves submitting an application to the concerned government authority and following their procedures for publication. Keep track of the deadline for dematerialization. If you are unable to resolve the issue with the RTA before the deadline, consult your legal counsel on how to proceed and whether you should request an extension.
