I am resident of gwalior and i became partner with two person of jabalpur for construction work by registered deed. But i came to know that they both have opened a fake bank account on my gst no in jabalpur . I want to know where can i file case in gwalior or in jabalpur because it is very tough for me to fiel case in jabalpur.

A.Dear Sir,
You have to lodge complaint in Jabalpur where the fake Bank account was opened if Police refused then file private complaint in the Magistrate Court of Jabalpur.

A.Dear Client,
Section 9 of the Civil Procedure Code, 1908 confers jurisdiction over the civil courts to adjudicate upon all suits of a civil nature, except such suits the cognizance of which is either expressly or implied barred. The Civil courts have four types of jurisdiction: 1) Subject Matter Jurisdiction: It can try cases of a particular type and relate to a particular subject. 2) Territorial Jurisdiction: It can try cases within its geographical limit, and not beyond the territory. 3) Pecuniary Jurisdiction: Cases related to money matters, suits of monetary value. 4) Appellate Jurisdiction: This is the authority of a court to hear appeals or review a case that has already been decided by a lower court. The Supreme Court and the High Courts have appellate jurisdiction to hear cases that were decided by a lower court. Section 20 of Civil Procedure Code, 1908 (CPC) provides that for any suit, every plaintiff may file a suit in the court of law within whose local limits the defendant/opponent against whom the claim arises voluntarily resides or carries on his business or is gainfully employed. Section 20(c) provides jurisdiction to the court which is located in the local limits of where the cause of action, “wholly or in part”, arises. So, considering the territorial jurisdiction and place where the cause of action arises, you need to file suit against your business partners in the Court at Jabalpur.

In a situation where fraudulent activities have been conducted using your GST number in a different city, you can choose to file a case in either Gwalior, where you reside, or in Jabalpur, where the fraudulent activities are taking place. Both locations offer the option to file a case.
