Hi Team, When I left my last company I had few issues with settlement of my leaving experience due to which I havent paid the recovery amount to the company.
I have a PF account in which they havent added EPS amount that is 8 percent which is clearly visible in PF passbook. Now when I am trying to transfer my PF to new company PF office is rejecting stating that EPS needs to be returned by the company first. Now my last company didnt reply me My money is stuck in my inactive PF account. Kindly help me how can I transfer my amount without contacting my last company as they havent added my EPS for 5 months.

A.Dear Client,
It is mandatory by law for employers to deposit the deducted EPF contributions into the employees' PF accounts within 15 days of the previous month's salary payment. Any non-compliance by the employer can result in severe penalties under the EPF Act.Employees/Ex-Employees can file a complaint with the EPFO against the employer for non-deposit of PF or EPS contributions either offline or in online mode directly through the official website of EPFO (https://epfigms.gov.in/). This can trigger an inquiry by the provident fund regulatory body. Employees can initiate a criminal case with the police under sections 406/409 of IPC or approach the chief vigilance officer appointed by the labor ministry. You will receive a registration number once the complaint has been registered. The details will be sent to you via email as well. Verification of the complaint is done by the EPFO before it is sent to the relevant department for resolution. It usually takes up to 15-30 days for the complaint to be resolved. When the grievance/complaint is not resolved on time, the PF subscribers can send reminders to the EPFO to resolve the complaint through the portal. The steps to send a reminder are as follows: Step 1: Visit the official website of EPF i-Grievance Management System and click on the 'Send Reminder' tab. In case of inordinate delay, you should visit the regional office of the PF Commissioner and get the anomalies in PF records corrected following the procedure as advised by the EPF Authority. If required, you may escalate your grievance before PF Appellate Tribunal with the assistance of an Advocate for a resolution in the matter.
