A.Dear Client,
As per Section 7(3) of the Payment of Wages Act, 1936, the total amount of deductions cannot exceed: 75 percent of the wages when the deductions are wholly or partly for payments to cooperative societies. 50 percent of the wages in every other case. Provided that where the total deductions authorized under sub-section (2) of Sec.7 of the Act, exceed seventy-five percent, or, fifty percent, as the case may be, of the wages, the excess may be recovered in such manner as may be prescribed. As per Sec.15(2) of the Act, where contrary to the provisions of this Act any deduction has been made from the wages of an employed person or any payment of wages has been delayed, such person himself, or any legal practitioner or any official of a registered trade union authorized in writing to act on his behalf, or any Inspector under this Act, or any other person acting with the permission of the authority appointed under sub-section (1), may apply to such authority for a direction under sub-section (3) in a claim arising out of deductions from wages or delay in payment of wages to the employee. Provided that every such claim application shall be presented within twelve months from the date on which the deduction from the wages was made or from the date on which the payment of the wages was due to be made, as the case may be. So, following the provision of the P W Act, you may escalate your claim application before the appropriate authority i.e, Regional Laour Commissioner, Asst. Labour Commissioner, LEO concerned, claiming a refund of the excess deduction made from your salary that exceeds the threshold limit as prescribed under the Act.
