We are 5 brothers. I have been living seperately from them since 2011. My father had kicked me out with the help of other brothers giving me only a small land to build house. I took loan and build a house in 5 years due to the poorest condition. He didn't give me any share in home.

In 2021, he died, when I asked my share of property, all my brothers started asking for money which my father had taken. While kicking me out, he never told me that he had taken money from relatives.

Now in 2023 also, my 4 brothers aren't willing to give me share of my property stating that they wouldn't give me unless I give them that money while that was taken without any signing paper or there is no document.

It is true that all they gave money to my father to get my sisters married and now they are asking the money which they had invested in the sisters marriage and the money which they had spent in the treatment of my father.

On the basis of spent money by all 4 brothers as explained above, can they bind me in any law that I will have to give money only then they will give me my share or property.

I am 60 years old and as of now only they have used all the property in every possible way.

They aren't ready to give me my share of property.

Please advise.

In India, the Hindu Succession Act governs the distribution of property among family members. According to the Act, if a person dies without leaving a will, their property will be distributed equally among their legal heirs, including sons and daughters. Therefore, the person has a legal right to claim their share of the property, and their brothers cannot deny them this right. If the brothers refuse to give the person their share of the property, the person can file a suit for partition in a civil court. The suit for partition is a legal remedy available to a co-owner of a property who seeks to divide the property among the co-owners.
