Sir
I ve been working in a central government department since a year. I am posted outside my hometown. Since beginning I have been subjected to derogatory and offensive language, slurs, and insulting remarks by staff members and officials. I have noticed a clear pattern of bias and discrimination against me in the workplace. I have been issued a warning memo and subjected to intimidation and threats by the appointing authority that since I am a probabtioner they can terminate me on their will. Kindly share your advice on this matter.
Thanks

A.Dear Client,
Irrespective of your status of employment, either probationer or permanent you deserve to be fairly and equally in terms of Service Rules of the Establishment. Any discrimination from colleagues or superiors amounts to an unfair practice. So, you should represent the matter in writing to the Deptt. Head for redressal of grievance. In the prevailing situation, you can escalate your grievance/complaint under Sec.19 of the Administrative Tribunal Act, 1985 before the CAT(Central Administrative Tribunal), if you belong to Central Govt. or SAT(State Administrative Tribunal), if you belong to State Govt. following the procedure of the CAT Rules of Practice, 1993 or respective SAT Rules for redressal of your grievance/complaint. Reach out to an Advocate experienced in CAT/SAT matters for guidance and steps.

A.Dear Client
Familiarize yourself with the policies and procedures of your workplace, especially those related to discrimination, harassment, and the disciplinary process. Understanding the internal policies can help you navigate the situation. If your workplace has a Human Resources (HR) department or an equivalent, consider reaching out to them. Explain the issues you are facing, provide documentation, and seek advice on how to address the situation within the organizational framework. If the internal resources do not provide a satisfactory resolution, consider formally reporting the issue to the appropriate authority in your organization. Follow the designated procedure for filing complaints, and provide all relevant evidence. If you feel comfortable, discuss the situation with trusted colleagues who may have witnessed the incidents. They could provide statements or act as witnesses if necessary. If internal mechanisms do not resolve the issue, you may explore external avenues. Contact the Central Administrative Tribunal (CAT) or any relevant body that handles workplace grievances. Seek legal advice before taking this step.
