Can you please let me know the name of latest Supreme Court judgment in which Court says " Printout of E-mails is not admissible in Court as evidence?"
A.Dear Client,
The 3 Judge bench of the Supreme Court comprising Hon'ble Judge, RF Nariman, S. Ravindra Bhat and V. Ramasubramanian, JJ has held that for admissibility of evidence by way of an electronic record, a certificate under Section 65B(4) of the Indian Evidence Act, 1872 is a required condition, as was correctly held in by the 3-judge bench of the court in the case of Anvar P.V. v P.K. Basheer. (Ref: CIVIL APPEAL NO. 4226 OF 2012, Supreme Court of India, Anvar P.V vs P.K.Basheer & Ors on 18 September 2014). Therefore, a Printout of E-mails is not admissible in Court as evidence unless a certificate under Section 65B(4) of the Indian Evidence Act, 1872 is attached.
