Dear sir , I have recieved a notice under the section mention above. Under the name of my elder brother who is no more in this world . He was having some credit card outstanding under his name . Now what should I do .They have asked him to appear before the court. Should I appear on behalf of him and submit his death certificate or what else should I do kindel assist .

A.Dear client,
If you don't appear then nothing will happen to you but they will keep sending letters and notices to your address.
The ideal way and also suggested is that you should appear once and submit the death certificate so that they can close the case for ever.

A.Dear Client,
A notice under Sec.20(2) of the Legal Services Authorities Act, 1987 issued when a LOK ADALAT is organized by the Legal Sevices Authority under Sec.19(1) of the Act on receipt of an application from any one of the parties to any matter referred to in clause (ii) of sub-section (5) of section 19 that such matter needs to be determined by a Lok Adalat. , Provided that no matter shall be referred to the Lok Adalat except after giving a reasonable opportunity to be heard to the other party. As per Section 20(3) in The Legal Services Authorities Act, 1987, where any case is referred to a Lok Adalat under sub-section (1) or where a reference has been made to it under sub-section (2), the Lok Adalat shall proceed to dispose of the case or matter and arrive at a compromise or settlement between the parties. When your elder brother passes away leaving credit card dues, on receipt of notice from the LOK ADALAT, you should appear before them to inform the demise of your brother in writing. If required you may hire a service of an Advocate to represent the matter suitably before the Lok Adalat for an appropriate order in the matter.
