Refund of EMD and Security Deposit

I have given EMD chq against a Tender to a party in June-23 , till date not received any update regarding tender and the EMD. Many times called and mailed for the same but they are replying and also not refunded the EMD. please suggest where to do the complaint and also have deposited Security cheque for contract which has been ended on june -23 . the same is with SD cheque. It's a humble request to suggest what to do now.

An unsuccessful tender should be refunded within 30 days after the conclusion of the contract. Unsuccessful tender will be refunded with a DD or a cheque issued by the bank that is endorsed by an authority.
You may complain to the Central Public Procurement Portal (CPP) and file a complaint in the general category. You may be required to upload the details of the EMD and SD in the portal.

From the contents of your query, it appears contradictory when you said the EMD cheque against a Tender to a party was given on June 23, and the contract which has been ended on June -23. However, it is to inform you that the EMD amount is refunded to a bidder whether he wins the tender or not. The EMD of an unsuccessful bidder is refunded after the finalization of the tender contract. The unsuccessful tenders will be refunded with a demand draft/banker's cheque that is duly endorsed by a competent authority. EMD furnished by all unsuccessful tenderers shall be returned to them without any interest whatsoever, at the earliest after the expiry of the final tender validity period but not later than 30 days after the conclusion of the contract. To verify the status of EMD is made through an A/c payee cheque you can go through the Bank Statement of the concerned Bank and for a refund of EMD you have to write to the concerned Company in reference to their tender notification claiming a refund of EMD. In case you find that the cheque is lost or misused by the concerned person to whom you gave the cheque, then you have to file a missing complaint to the local police station and the concerned Bank.
