A.Dear Client,
In a situation where your employer has incorrectly submitted your Provident Fund (PF) amount in the Employee Pension Scheme (EPS) account, and they are not assisting in the withdrawal process, it's important to take proactive steps to address the issue. Begin by reaching out to your HR department or payroll team, making a written request for correction and withdrawal of the funds. Clearly communicate the urgency and the impact on your financial well-being.
If your employer remains unresponsive, you may consider filing a complaint with the Employees' Provident Fund Organisation (EPFO). Visit the EPFO website, lodge a grievance, and provide details of the issue. The EPFO authorities can intervene and facilitate the correction of the submission.
Additionally, consult with a legal professional or a labor law expert who can guide you on the specific steps to take in your jurisdiction. They may be able to provide legal avenues to ensure the correction of the PF submission and the timely withdrawal of your funds. Document all your communication and keep records of your attempts to resolve the matter, as these may be valuable in any legal proceedings.
Thankyou

A.Dear Client,
In the given situation, Employees/Ex-Employees can file a complaint with the EPFO against the employer for non-rectification of error caused by default in PF or EPS contributions either offline or in online mode directly through the official website of EPFO (https://epfigms.gov.in/). This can trigger an inquiry by the provident fund regulatory body. You will receive a registration number once the complaint has been registered. The details will be sent to you via email as well. Verification of the complaint is done by the EPFO before it is sent to the relevant department for resolution. It usually takes up to 15-30 days for the complaint to be resolved. When the grievance/complaint is not resolved on time, the PF subscribers can send reminders to the EPFO to resolve the complaint through the portal. You can file a complaint using the EPF i-Grievance Management System (www. https://epfigms.gov.in/) or email to:[email protected].
You can also approach the chief vigilance officer appointed by the labor ministry. However, in case of inordinate delay, you should visit the regional office of the PF Commissioner and get the anomalies in PF records corrected following the procedure as advised by the EPF Authority. If required, you may escalate your grievance before PF Appellate Tribunal with the assistance of an Advocate for a resolution in the matter.
