A.Dear Client,
According to Sub-Section 3 of Section 5 of the Maintenance and Welfare of Parents & Sr. Citizens Act, 2007, on receipt of an application for maintenance under sub-section(I), after giving notice of the application to the children or relative and after giving the parties an opportunity of being heard, hold an inquiry for determining the amount of maintenance. As per Sub-Sec..4 of Sec.5 of the Act, an application filed under sub-section (2) for the monthly allowance for the maintenance and expenses for proceedings shall be disposed of within ninety days from the date of the service of notice of the application to such person, provided that the Tribunal may extend the said period, once for a maximum period of thirty days in
exceptional circumstances for reasons to be recorded in writing. As per the provision of Sec.17 of the Act, no party to a proceeding before a Maintenance Tribunal or Appellate Maintenance Tribunal shall be represented by a legal practitioner. This benevolent act is exclusively enacted for the protection of the safety and security of Sr.Citizens who are being harassed and abused by their children/relatives in their sunset years to lead a life with dignity and peace. A.Dear sir,

Normally within six months the nodal officer that is assistant commissioner in Karnataka is suppose to dispose the case.

A.Dear Sir,
It depends upon the volume of work which the Assistant Commissioner is dealing with. Normally, it has to be decided within 6 months. You may request and get it disposed if you are in urgency.
