Double resignation
I resigned in aug 2023 and my manager convinced me to stay saying if he didn't give me a raise he'll lower my work hours to 30hrs/week. I agreed verbally but did not send any withdrawal letter. When hr asked for a discussion on this i MESSAGED I discussed with manager and want to continue work and will send withdrawal letter soon. I didn't send any. I got another job and resigned in jan 2024 with my joining next month. My notice period is 90 days and they are not allowing me a buyout. Can i use aug 2023 resignation even though i stayed till jan 2024 and resigned again ? I asked this in another post but forgot to mention my jan 2024 resignation. I mentioned cause of resignation in aug 2023 as mental health issues caused by work and masters plan and for 2024 i mentioned new job. The company is in Bangalore. Once you tender your resignation afresh in January 2024 the earlier resignation of August 2023 stands infructuous and invalid. Accordingly, the 90-day notice period starts afresh from January 2024. The reason behind the resignation does not matter if the terms of employment are complied with and non-compliance with the terms of employment may be held breach of contract and may liable you to face legal consequences that may affect your service career in the future. So, handle the situation carefully and wisely following the steps as suggested in response to an earlier query made on the same subject.
It's essential to clarify the details with your current employer and communicate effectively. While you initially resigned in August 2023 and verbally agreed to stay with certain conditions, the subsequent resignation in January 2024 may supersede the previous arrangement. The reasons cited for each resignation differ, with the first mentioning mental health issues and masters plans, and the second indicating a new job opportunity. It's advisable to be transparent with your current employer, explaining the circumstances and reasons for the second resignation. Seek a discussion with HR or your manager to explore options for a smoother transition, considering your notice period and the potential for a buyout, even if it requires negotiation. Professional communication and transparency will be key in resolving the situation amicably. If needed, consult with a legal professional to understand your rights and obligations in this specific context.
