Sir,
i am working in a School operated by an samiti. They make a Karmchari Kalyan Kosh and add all the employees (approx 250) without our permission or any information. They are deducting rs. 300 per month from our salary for that. they said that we can take loan benefits and we will get bank interest on that amount. Karmchari Kalyan Kosh has members to operate it. but all the members of samiti was chosen by samiti. so they choose president and other member according them.They said that they are depositing our money in bank but they refused to give information about bank details. actually they are using our money and getting interest by market. If we refuse to deduct amount from salary they threat to terminate.so please help me what we can do about it.

A.dear client in your matter You have the right to get to know the amount that is being deducted from your salary and it can be only deducted after taking permission from you. Request you to kindly share across the appointment letter, pay slip etc for review.

A.All employees agency Samsta or Kosh are controlled by various Act and regulated first it should have established with all the legal formalities, and aims & objectives specified and duly registered under the act. It should have its own memorandum & articles and charter of membership and management. Under Payment of wages act no unauthorised salary deductions can be made from employees salary. In the past no. of illegal & unauthorised agency,union or kosh have misused & cheated employees hard earned money.You can organise and make complaint to ALC of your area, If need engage a Labour & Employment and service Lawyer to guide you & help you quickly.

A.Sir,
Lodge a complaint before the PF authorities.They can take action against samiti.

A.Deducting any amount from the salary without any reason or consent of the employee is against the labour laws and they can be booked under the laws. Find out if they got you to sign any document where you agreed for 300 rs. deduction. If not then initiate a complaint against them to labour commissioner.
