Jammu University shortlisted 17 candidates for interview and selected a candidate for the post of assistant professor and recommended his name but later on while conducting verification of documents, due to some fake certificates his candidature for the said post was cancelled. What will be the next proceeding of university. Should it cancel the list or recommend another candidate from the wait list or take the fresh interview again of the eligible candidates or re-advertise the post. What are the guidelines of UGC in this regard.

If an employer discovers during any stage of recruitment that a candidate has submitted false certificates, legal action can be taken post-selection, leading to consequences such as candidature cancellation, termination, fines, and potential imprisonment.

Issuing or signing a false certificate, especially one required by law or admissible in evidence, is subject to punishment similar to giving false evidence. Individuals possessing fake degrees may face charges under various sections of the Indian Penal Code (IPC), including cheating, forgery of valuable security, forgery for cheating, using forged documents, and abetment of criminal conspiracy. This can result in imprisonment for up to seven years.

Section 465 of the IPC stipulates that forgery is punishable by imprisonment, a fine, or both. In such cases, the university may opt to restart the recruitment process or recommend the next shortlisted candidate after further screening, as determined by the Selection Committee following UGC guidelines.

A.Dear Client,
Using fake certificates and credentials can damage the institution's reputation, causing people to question the value of the degrees and qualifications it awards. Using a fake/false certificate is not only ethically wrong but also illegal. If an employer finds out at any stage of recruitment or selection that a candidate has submitted a fake/false certificate, they can take legal action against him even after his selection against a vacancy. The potential consequences could include cancellation of candidature, termination of employment, legal fines, and even imprisonment in some cases. Whoever issues or signs any certificate required by law to be given or signed, or relating to any fact of which such certificate is by law admissible in evidence, knowing or believing that such certificate is false in any material point, shall be punished in the same manner as if he gave false evidence. Those who possess such fake degree are charged under Section 420 (cheating), Section 467 (forgery of valuable security), Section 468 (forgery for cheating), Section 471 (using as genuine a forged document) and Section 109/120B (abetment of criminal conspiracy) of Indian Penal Code (IPC). The wrongdoer will have to face up to seven years of imprisonment. According to Section 465 of the IPC, forgery is punishable by imprisonment, which may extend to a sentence of two years, a fine, or both. In the given situation, the university may initiate the recruitment process afresh or may recommend the name of another from the shortlisted candidate who scored next to the earlier candidate after further screening as may be decided by the Selection Committee formed following the UGC guidelines.
