Is defamation case possibile
So I had bad experience with a brand, they took some xx thousand from me and didn't provide service. When asked for refund stated there is no refund policy. So I put a query on social media, asking the legal aids what's to be done. I revealed the brand's name as it's pretty known in my city. After that they got some 5 bad reviews based on my query. They sent a lawyer to talk to me and asked me to sign an agreement stating well refund after you make another post stating that I've got refund and company is good. I declined. But they are too furious about the bad reviews and hence involved a lawyer. They don't have link to my query as it's deleted. They just have my one verbal statement where I said people might have used my query as source and that's why given you all bad reviews. Is there a defamation case possible? The last msg I sent them js I don't wish to speak to their lawyer or then and want to be get done with this. They've not reacted yet, neither given me the refund.
These online job opportunities are often presented by fraudulent companies/entities aiming to exploit unemployed individuals for money. In the face of such unethical and arbitrary threats or demands from such entities, it is advisable to simply disregard them, as the nature of the threats reveals their malicious intentions.
However, if you receive persistent calls, messages, or emails demanding money for various purposes or threatening legal action, take appropriate action. Lodge a complaint (General Diary) against the company at your local police station, providing any relevant papers, documents, or digital evidence you may have. Simultaneously, issue a legal notice to the company, attaching a copy of the police complaint (General Diary) and informing them of your intention to pursue a criminal suit for cheating and criminal intimidation under sections 415 and 503 of the Indian Penal Code. This approach is preferable to a defamation suit, which is complex and costly. This course of action may lead to a resolution of the matter.
This kind of online job is being offered and operated by Fraudster companies/entities to extort money from unemployed youths. So, on receipt of such an unethical and arbitrary threat or demand from such type of Company, just ignore it because the nature of the threats itself proves their ulterior motives behind the offer. However, on receipt of repeated calls or messages/emails demanding money for different purposes or threatening legal action, then make a complaint(GD) against the said Company at the local police station with whatever papers/documents or digital evidence you have and serve a legal notice enclosing a copy of the police complaint(GD) informing them that you are contemplating filing a criminal suit against the Company for cheating and criminal intimidation u/s.415 and 503 of IPC instead of defamation suit that involves lot of complexity and expensive too. Hopefully, the matter may stand resolved thereafter. In case the matter is not resolved, then consult with an Advocate for guidance and steps to navigate the matter in the right way.
