Undivided share of land

My father is a builder he constructed an apartment he purchased undivided share of land along with others he gave an agreement to construct further floors of buildings residential purpose on awnership basis but he didn’t constructed he died his son went to civil court to claim the terrace.the flat owners signed the agreement now they are objecting who will win the case
