Compassionate appointment of sister on death of unmarried brother

Can a unmarried sister claim compassionate appointment in place of his unmarried brother if the employee's father is a state government employee ?

As per the Department of Personnel and Training, Ministry of Personnel, Public Grievances, and Pensions, Government of India Office Memo dated August 2, 2022, a government servant retired on medical grounds before the age of 55 (or 57 for Group 'D') is eligible to apply for compassionate appointment for a dependent family member, including spouse, son, daughter, brother, or sister. The application is to be submitted to the competent authority, such as the Joint Secretary, Head of Department, or Secretary, depending on the case. Compassionate appointments are for Group 'C' or 'D' posts under the direct recruitment quota, with eligibility criteria including indigence and suitability for the post. It depends upon State Government circulars. Please check with concerned department and in most of the States now it is made convenient to get appointments on compensate grounds for unmarried ladies.

As per Deptt. of Personnel and Training, Ministry of Personnel, Public Grievance and Pension, Govt. of India Office Memo no.14014/1/2022 - Estt(D) dated 02/08/2022, Clause 2(A)(b) & (c), a Government servant who is retired on medical grounds under Rule 2 of the CCS (Medical Examination) Rules 1957 or the corresponding provision in the Central Civil Service Regulations before attaining the age of 55 years (57 years for Group ‘D’ Government servants); or is retired on medical grounds under Rule 38 of the CCS(Pension) Rules, 1972 or the corresponding provision in the Central Civil Service Regulations before attaining the age of 55 years (57 years for Group ‘D’ Government servants is eligible to apply for the compassionate appointment of his or her dependent family member that includes (a) spouse, or (b) son (including adopted son); or (c) daughter (including adopted daughter); or (d) brother or sister in the case of an unmarried Government servant to the competent authority that includes (a) Joint Secretary incharge of administration in the Ministry/Department concerned. (b) Head of the Department under Supplementary Rule 2(10) in the case of attached and subordinate offices. (c) Secretary in the Ministry/Department concerned in special types of cases The appointment on compassionate grounds is made against the Group ‘C’ or Group ‘D’ posts against the direct recruitment quota and eligibility criteria are (a) The family is indigent and deserves immediate assistance for relief from financial destitution, and (b) Applicant for compassionate appointment should be eligible and suitable for the post in all respects. The upper age limit could be relaxed wherever it is found to be necessary. As per Clause 7 of the scheme, appointment on compassionate grounds should be made only on a regular basis, and that too only if regular vacancies meant for that purpose are available.
