Dear Client,
You need to go through the provisions of the Byelaws of the Society that govern the activities of a registered society. You also need to find the minute book or resolution files of the Society. If the Byelaws of the society are silent over the subject, then the executive committee(EC) can pass a resolution on a two-thirds majority of votes in a duly convened meeting for changing fines or penalties on delayed or non-payment of maintenance charges from the resident member. If such a resolution is in place, then the society can charge fines for late or nonpayment of society maintenance charges from the defaulted flat owners.
