I was promoted to Ad-hoc AAO by passing the departmental exam. Head Quarter issued a circular on 02.07.18 by which eligible candidate may appear in SAS Civil Audit exam. I sought clarification from Local Admin (my office) regarding my eligibility but I was not answered that time. Later regular promotion order was issued in favour of me on 10.08.19 and Local Admin. issued a circular on 29.08.18 inviting me to fill up the form for the said exam. Hence I refused to accept the promotion on 29.08.18 as after getting regular promotion candidate was not eligible to appear in the said exam. Later Head Quarter denied me to appear in the exam giving reference to its earlier circular dated 02.07.18. In this situation I was debarred for getting promotion for 1 year and could not also appear in the exam. Had I not been allowed to fill up the form, I would not refuse to accept the promotion.
I think department is at fault who invited me without consulting the Head Quarter and I sought clarification also from my office.
Pl guide me whether I should knock the door of court to get the promotion from the back date
You may approach High Court or Service Tribunal.

With a prayer of
1. Allowing you to sit for such exam vide there invitation dated 29.09.2018
2. Give you regular promotion from such date as everyone had got.
In case they fail to comply, then you may legally proceed with the same.
But before that send them a legal notice.

You may go for write T High Court at your jurisdiction of office or if head quarter office either of , your claim against non disclosure of eligibility criteria and hence lapsing your chance dept. Exam. For promotion.
You may consult fir the same writ filing .
