This is to report that Scams are still going on in Kolkata even after so much investigation from state govt and Central Govt intervention. We are a group of investors who had invested in this Project in the year 2016 and the developer instead of completing one project has taken up several projects one after the other. This particular builder called USASHI REALSTATES PRIVATE LIMITED has accepted application money from 2000 to 3000 applicants from the year 2016.
Now the applicants have realised that the land does not belong to them and it is a scam . When applied for refund , they are not paying the applicants back.As usual this is a failure in the real estate sector due to non adherence to RERA rules in West Bengal. Moreover , this developer is continuously advertising and still playing with the lives and hard earned money of the people here in West Bengal. Each applicant has paid 2 lakhs to 7 lakhs on an average. This group of people are directly threatening us and asking us to go to the court. Their cheques are getting bounced and there is no sign of any refund . They have used several celebrities like Prosenjit Chatterjee, Shaheb Chatterjee , Indrani Halder , Koel Mullick and even Sourav Ganguly for advertisements. This looks like a huge scam which even the authorities are hesitant to take up. Thousands of common people are affected but the local media, police and authorities are turning a deaf ear to this . There is failure of law and order even in the real estate sector in West Bengal due to non - compliance of RERA.
Get file a PIL before High Court or approach Electronic Media.

Scams like this do happen but that does not mean that all the persons and genuine buyer can suffer due to some wrong people. The law does provide you the mechanism to fight it out in rightful manner and recover your losses. Depending on what the builder was going to build and what all services the builder was going to provide you can file a case in Consumer Forum (in this case State Forum).
Depending on on agreements were signed and how money was paid you can file a civil suit to for breach of contract.
Simultaneously you can lodge a complaint with local police for fraud and cheating.
Additionally you can invoke the provisions of HIRA to bring the builder to the books.
