Dear Sir, Would like to know that can i being a son in law file a case against my step mother as she has mentioned her name in my wife's school certificates.Secondly, both my motherinlaw and step mother in law are staying together after my father in law's second marriage without any legal divorce and my father in aw and step mother in law are both govt. servants. Is there any procedure where i can initiate a departmental inquiry against them and take adequate measures to punish them .Sir,my father in law is staying with my mother in law just to avoid legal complications and my mother in law being very orthodox and uneducated still believes in the patibrata culture and is afraid of taking any legal actions. Plz guide me through any procedures where i can initiate a departmental inquiry so that they understand and atleast behave properly.Request your help.

A.dear client in your matter you can file a case against any one, there is no barrier as to Son in law or son. If some one has done a wrongful act then you can take legal action in this regard.The marriage of Hindus are governed by Hindu Marriage Act, 1955 (as amended till date) and according to this act no person can marry twice during the lifetime of his spouse living until and unless he has obtained a decree from the court.So, the act done by you father in law is bad in Law.

A.Dear Client, It is very unclear from your post that what exactly your want and need. Although from my point of view if your are asking that how to nullify the second marriage of your father-in-law then I must tell you that the second marriage of your father-in-law is not legitimate. A.Yes, Legal Action can be taken. But, your mother in law has to come before the court to give evidence. Adultery, nullity of 2nd marriage are the best forms cases which you can initiate.
