Family matter after sister death

What is the ligal way to take back sister's 5 moths old son after sister death for to nurse the child because my sister's husband given child to his sister parmanently and make this child own .Please suggest ligal way to back sister's child just to nurse
A.If your sister's husband has done this without any valid procedure then you can approach to the court and get an order against him for doing this.
