I have, after driven from my co-shared flat by my wife, planned to file a partition suit under Hindu Succession Act 1956 for my right of 50% share of my flat. I will by myself fight the case. Now my question is:
a) Will this be judicious to file the case under already mentioned act?
b) Will I be able to include my share of locker/my investment papers/gold coins/ my private car-an FIR was made but police has given final report about the car only ( with the exclusive rights I have) under the partition suit case?

A.Dear Sir,
Whether you are invested 50% of sale price then only you can file suit for partition and getting 50% of your share and not under the said Act.
