Sir/madam I had a petty case for driving without licence so my advocate told me to do write my name and do singnature on a single blank papper ... So I do what he say like I writed my name and I done signature on a blank papper .. if it makes any problem for me in future or in case of properties in anyway?

A. certainly signing on blank paper may be a bog trouble for you. ask him to return back the papers

My brother is in government service. He come in contact with a girl through Facebook. The girl convince him for marriage. And they got married through Arya samaj. After one week of marriage it was found that the girl had trapped him for money . It is also found that the girl has already in relation with other guy. She filed a case on my brother for monthly maintenance. And a second case for dowry. How did we get rid of this . Please suggest any advise for divorce too.

The Petitioner/Plaintiff and the O.P./Defendant got married under the Special Marriage Act, 1954 on 07th January, 2013. And on 01st December, 2017, the Petitioner/Plaintiff instituted a Petition/Plaint for divorce against the O.P./Defendant under Section 13 of the Hindu Marriage Act, 1955 with the false aligations. And Her aligations are :- 1. That the petitioner and respondant are husband and wife and their marriage was performed on 06/12/2012 at Registry office and after the marriage both the parties has never lived together as husband and wife since 05 years. 2. The marriage was not solemnized according to the rituals and traditions of Hindu family, it is only a registry marriage under Hindu Marriage Act 1955 and neither they performed honeymoon or nor any cohabitation since the date of registry marriage. 3. That since the petitioner is the sole daughter and heir of the parents and the respondent is indulging and blackmailing and threatening of expose of their private photographs on the facebook of 42 spectram. 4. Blackmailing by O.P./defendant through mobile communication. 5. Heavy monitory demand by O.P./defendant from Plaintiff's father. 6. That registry marriage is also doubtful and Plaintiff was not presented before the district registering authority. 7. Cause of action arose on 06/12/2012 when the marriage of the both the parties were performed, It also arose on several occasions and lastly on 30/09/2017 when the respondent has last given marriage on the face book. . It is submitted that the Certificate of Marriage under the Special Marriage Act was filed by the O.P./Defendant along with the petition of RCR U/s 22 of SMA 1954 on 05/02/2018. It is further submitted that the aforesaid Certificate of Marriage dated 07th January, 2013 is deemed to be conclusive evidence of the fact that marriage under the SMA 1954 had been solemnized and that all formalities respecting the signatures of witnesses have been complied with. So, the parties to such a marriage will not be governed by any of the provisions of the Act. Is the learned Family Court has jurisdiction to entertain and try the Petitioner/Plaintiff’s petition under HMA 1955? As both the parties are governed by the Special Marriage Act. The divorce petition/plaint filed by the plaintiff is gross abuse and misuse of the process of law and is, therefore, dismissed? Please help! how to reject divorce plaint filed by wife? Please provide me a petition format for rejection of divorce plaint Under CPC.

I have applied Contested Divorce through a lawyer but in the meanwhile, my wife applied compliant in the police station. As I got a call and informed that your wife lodged a complaint in my home town. As I doubt that she was trying to arrest or hold me and my family in jail. After marriage (1 month later), I found she was cheating for 2 years we are only having disturbance with each other(no Kids). And she left home on Nov 2017 after that she never came home as i work in Gurgaon. Even we had meeting on Jan2018, through our community I said if she is good behavior I will take her back but her mentality didn’t change again she started threating me by her family members and relatives. So I feel unsecured and threatened by my wife family. Now I am feeling doubt that even after visiting to my hometown for the police station I feel scared. Even as per the lawyer he says that he got case number for contested divorce but as per my knowledge he have to get 5 signs from the court .Is it good to visit my home town as I have only number nor the papers . or I need any other precautions to be taken before going to police station becoz I am weak and I doubt that they may arrest me . Due to that I may lose my job

My son is a motivational speaker and tarrot card reader, 10 years back he had advised a client to buy some shares. He made huge loss because he did not follow stop loss strategy. After one year he committed suicide. My has son has no connection for a year or more before he committed suicide. Now someone from his family asks for ransom money after 10 years which is a huge amount. We refused, they are threatening to get him arrested while my sons live program in Mumbai. We are innocent. How can police arrest, what are our rights? Please guide.

A. Any proof of advise? Any suicide not? His name in FIR? No case can be framed. In case of any prob contact me.

Our marriage was held on 19-06-1998 and we were blessed a son on 23-03-1999. We lived happily. There were some disputes which common in all families. My wife left me on 19-09-2014 blaming me with simple reasons and living separately under the supervision of another person. This person was provoked my wife and became the reason for separation. Many times I and my relatives and well wishers approached her and her parents but no use. They strongly decided not to join in society. In 08-10-2017, I and my friend approached her aunt for convincing purpose. But my wife felt ashamed and threatened me by saying "I can send the divorce notice and file DVC". To protect my self I filed a petition u/s 9 of HMA i.e. RCR on 18-12-2017. In reply to that petition she filed the counter abusing that "I had tortured her in mental, physical and sexually", and IA petition u/s 24 of HMA for maintenance. At the time of marriage she was only 10th class and I taken the all the risks and encouraged to study. She completed BA BEd. Diploma in Classical Music with my support. She had worked in private school for 4 years. After getting earning capacity and with the provoking of another person and her sisters and mother she left me on 19-09-2014. At present she has been working in a private school and earning. Suggest me how can I protect my self. Can I file order 16 rule 6 of CPC. Suggest me how to approach further. Hope your advice will help me a lot. Thanking you sir/madam.

A. It is still not clear what you want protection FROM. Whether she threatens or not, if she files a complaint under DV Act, you would have to defend it and as long as you have really not done anything she says, you are safe. It is not possible to get any protection against "LEGAL" proceedings.

can we charge a existing member for incorporation of name in share certificate as there is change in surname as we usually take from new members (ie.Rs.500/-) or can we make changes in the share certificate (front side) as he is the 1st owner... has submitted all legal documents related to it

A. Dont get dishonest. You cant charge from members for change in name or etc. However you can refer your bylaws if something is mentioned therein with regarf to this

Dear Sir I have taken a hand loan of amount 5 Lacs from a neighbor a year back. paid all outstanding interest till this month. Now he is immediately asking me to settle the 5 lac amount. I need another 3 months time to arrange the amount. Kindly advice if legally i have any options to do so

A. you send him a letter stating your financial condition and ask for 3 months grace. If he doesn't allow that then in that case let him file a suit against you. That letter will be the best available defence in your case. Wherein which the court can grant you the time and dismiss his case.

hello sir,i want to know my tenant didn't pay rent since 8 months.we have a filled eviction suite now she is claiming that she has cleared all the arrears and rent she has given us liquid cash to hand without any proof .she asked judge time may be she will get one false fake evidence my question is can we file a criminal case on her she damaging our reputation time and money with false allegations can we file criminal case against her please tell me.

A. Yes you can. Moreover if she has stated that she doesn't have proof in that case your case gets more strong even if she files a fake evidence. If the evidence is a document go for foreign seek test by taking the leave of the court. If the evidence is a witness then such person can be broken in the cross examination.
