I purchased on 3 July 2023 Asus Rog Strix laptop from laminton Road shop named The Next Generation, He sold me saying it was new but when i got home I checked the laptop the laptop backpanel was opened earlier and on keyboard there are always processor and graphics card sticker compulsory present on it none sticker was on the laptop that i purchased. As the charging cable is not original I confirmed it from Asus authorised service centre, The shop owner deny me to give refund or replacement saying it is new. Also Asus India in not helping in this matter they say that contact to dealer and end the query from their side. I don't have any solid proof for police complaint they ask for solid prove what to do

A.Dear Client,
When you bought a laptop from the Seller you must have got a GST Bill from him. So, on detection of defects in the product, it is termed and defined under Sec.2(34) of the Consumer Protection Act, 2019 as "Product Liability" which means the responsibility of a product manufacturer or product seller, to compensate for any harm caused to the consumer by such defective product manufactured or sold or by a deficiency in services relating thereto. So, as a Consumer, you can file a complaint u/s.35 of CPA, 2019 against the Seller on the basis of GST Bill for deficiency in service and unfair trade practice before the Dist. Consumer Commission claiming refund of the entire value/cost of the defective product or replacement of defective product along with compensation for harassment and cost of litigation. In case you need any legal assistance in the matter, you may contact our legal team along with relevant papers. The complaint need to be filede before the Dist. Consumer Commission within TWO YEARS from the date of cause of action.

This is a consumer dispute. Please file a complaint under section 35 of the consumer disputed act for malpractice adopted by the vendor in the consumer disputes redressal forum and claim damages
