A. Mutual Consent Divorce is the only way to get divorce in shortest possible time. Both parties must come forward for this together.

Hi I and my husband are separated for the past five years .There is a criminal offence against my hubby filed by me under procso act and that case is in stay at HC. The gold which my parents gave to me are at my husband's place in our joint bank account. Hoe can i get back my gold. How should i move in court. I havent filed for divorce yet due to this. If i file for divorce will i get my gold back. Can you please advice me

A. A joint bank account can be operated by both the account holders so what you do is that you go to the Bank, access your account or locker and take back your gold. If for any reason you are not able to do that then remember to mention that gold as your "stree dhan" which is absolutely your property and post divorce you will get the custody of that.

sir my husband sent 2divorce notice later he given false complaint in police station. so v applied divorce. now he is nt ready to gv divorce instead he filed case on me from his mother from his native place. already divorce case is going in my native place. is it posible to transfer the case which his mother filed on me. and what is the meaning of intimation served and wt next step court will take plz reply me

A. Dear your Husband's mother cannot file a divorce case, it must be your husband who would have filed the case. If you have received the court summons for the divorce case then you must appear in the court otherwise the court will pass the judgement "ex parte" meaning in your absence. Immediately take action and yes you can also request the learned court to transfer the case to your hometown. There is a process for transfer and you will have to follow that.

A. You cannot reopen the case once it is dismissed on this ground. You can file fresh with all the requirement. Please also understand that many a times the case get dismissed on the technical grounds and hence it is pertinent that you hire a good lawyer who can assess the case and file it in a failure proof way as far as possible. Take the old case file to a lawyer and discuss with him.

A. There is no way (legally defined) to disown one's wife. If you want to get separated then you will have to file a case of either judicial separation or dissolution of marriage (divorce)

Hi, After i become a widower, I got married to a girl who is actually not willing to make a family. She was actually looking for someone who can afford her. I had to get married because of my son. After marriage i left my son with her in Kolkata but he was not doing well so i took him back to me in hyderabad. When asked why he is not willing to stay there, he told me that she used to beat him. She is only concern about her and not about the family. When i am still looking after my son as a single parent then what is the point of being with her. Why should i spend my hard earned money on her. Please sir, tell me how to get rid of her. Thanks

A. Since you do not want to continue with the marriage then it then case you can go for dissolution marriage by divorce and it is well known a fact that Mutual Consent Divorce is the best way to go about it. Having said that you also will have to be aware that yo will have to either pay her one time alimony or monthly maintenance as agreed by both of you and ascertained by the court.

sir am aplied for divorce. and now my husband agreed to give divorce. now is it needed to withdraw my contested divorce and again am i apply for mutual divorce with him or am i get divorce by the case filed by me only? am from karnataka. please give me sugestion bcz our lawyer dnt say anything to me.

A. If your husband has agreed then let him say this in the court that he does not want to contest and the Learned Court will take cognizance of that and pass the decree for divorce. There is no need to file a separate case again unless there the COurt is asking for any technical reason.
