A. Dear client,
She can only say no to a mutual divorce but does not have any right to file an additional case on the basis of the divorce case filed. She may file additional cases on the basis of false information such as a section 498A case, but cannot file any legitimate case against the divorce.

A. Now adultery has been scrapped off by the supreme court and so you are on safe side. Do not reveal your pregnancy during the divorce case and let the lawyer attend the next dates till 1 year.

A. You can file the RCR as well as maintenance even today without waiting for the dismissal of the case. In fact you should file the RCR as soon as possible as that will make your case stronger against your husband in divorce matter. If your husband is able to reopen the case and take it further then it will be problematic for you.

A. Dear client,
it is high time that the notice stage should be passed. Usually, 3-4 notices are issued to the defendant and after that, the next stage proceeds. You can change your lawyer by getting a NOC ( no objection certificate ) from the old lawyer and submitting it to the new lawyer.

A. What case have you filed? is it a divorce case? If yes then consult your lawyer who should take action to move the petition fast. Ask him the reason why the case is lingering and not moving ahead. Since the Covid-19 is kind of over and the courts have started functioning normally the case should move fast.

A. Anything that happened before the marriage can be called as adulterous and your husband will not be able to get any benefit out of this while filing a divorce case in the court. Past relationships are just a fact which can be mentioned in the case but will not go to the extent of deciding the case.

A. Marriages and divorces are regulated by the personal laws and tradition as applicable to the individuals. In case you are not covered under the HMA then you can follow your own traditional tribal method and post that yo can apply for a declaration suit in the local court for the same.

'M' can file a case under section 498A of IPC. Whoever, being the husband or the relative of the husband of a woman, subjects such woman to cruelty shall be pun­ished with imprisonment for a term which may extend to three years and shall also be liable to fine.
