A. Dear client,
In order to get custody of your child, you need to file a custody petition under the relevant legislation. The court will take into consideration factors such as the child's wellbeing, financial status of both parties, etc. before ruling on who will get custody.
Thank you.

A. Dear client,
I cannot give a definitive answer as to whether it would count as dowry or not. It depends upon the cost of the items along with the circumstances under which the gift is being given. Usually, such items may not be considered as dowry but it cannot always be said so.
Thank you.

A. A mutual consent divorce Decree passed by Foreign Court is considered as valid, legal and binding in Indian Courts by virtue of section 13 and 14 of the Code of Civil Procedure, 1908, as amended up to date and also on account of comity of Nations and that need not to be validated in Indian Courts, however, if you wish then you can file Declaratory Suit in India for declaration regarding that divorce.

A. Dear Client,
Not more than 25% of your salary can be directed towards the maintenance of your wife as per the order of the supreme court. But it will be advisable to go for Divorce by Mutual Consent and give one-time lumpsome alimony.
Thank you

A. Dear Client
Since she is a co-borrower the bank will not allow you to register the property solely on your name and as per the procedure her name too will be included in the Sale Deed. That means she is also an owner of 50% of the flat and in that case you can forbid her from coming to that flat.

A. Dear Client
If your wife has done like this then you are left with one more option to file a contested divorce on the ground of cruelty against her. You can showcase the MCD signed petition to the learned court as a piece of evidence but then you also need to tell the court why she has gone back.

Birth certificate -without a father name Birth certificate -without a father name

I got divorce now, I need to get the birth certificate for my child (1.10 yrs old) without a father name. (single mom) What is the procedure for that?

A. Dear Client
Since the child is born out of wedlock its not wise to have just the mother's name. The authorities do not oblige for the same unless its a single mother in the real sense like an unmarried woman goes for IVF and have child. Since the procedure is yet not set for registration of single mothers in Most of the cities you are advised to visit the registering authorities and request them for the same.

Divorce Case -divorce decree Divorce Case -divorce decree

In my divorce case, I (husband) is petitioner and respondent wife has given in writing to the court that my divorce petition should be allowed and I should be given the divorce decree. What next step

A. Dear Client
If your wife has provided her consent to allow the divorce and there is no objection from her side then you/your lawyer must apprise the court on the same and seek the direction from the court to dissolve the marriage. On an affidavit the same contested can also be converted to MCD.
