A. Filing an application for quashing of false FIR under section 482, CrPC in the High Court is one course of action. Further, a writ petition under Article 226 of the constitution can also be filed in case of a false FIR.

A. Hi,
Dowry is a punishable offence and would attract legal complications. If a harassment case is initiated against you, then you can show the voice recordings as proof which prove the opposite of her claims. It is always advisable for you to settle the issues out of court and amicably and filing a case must be seen as the last option. If your wife is ready for a settlement, please go ahead with it.

A. Hello Sir
There is nothing we could legally help you with in this problem. Although if you want you could file for a divorce. But it would be suggested to contact a marriage counselor and sort your issues out with the help of him amicably, to avoid further complications and save your marriage.
Thanks

A. Hello Sir
If the offences in the criminal case are compoundable then you could settle the issue outside the court. Also both the criminal cases and family court cases are different they cannot merged. First settle the issue in the criminal case and at the same time your family court would go on.
Thanks

A. The amount of maintenance depend upon earning of parties ,their status etc so if wife does not have independent income or does not have sufficient income to be able to maintain herself then court should consider total earning of husband from all sources be it pension, fixed deposits, rental income if any etc and can award upto 50% if total income if husbabd as maintenance to wife.

You can file a case for restitution of conjugal rights against husband and domestic violence against concern persons who are creating disturbance . Simultaneously claim for maintainance . A. Your son can file divorce case and for filing divorce case your son does not require any consent or permission from his wife. Your daughter in law has every right to oppose the divorce petition filed by your son and also to refute allegations as would be levelled by your son seeking divorce. Your daught in law is also entitled to maintenance, independent residence, alimony and other legal remedies.
