A. You can file for divorce on the grounds of cruelty and irrevocable breakdown of the marital relationship. You can also file a complaint with the police under S.498-A of the Indian Penal Code for the same. During the course of proceedings, you can claim interim maintenance from him under S.125 of the Criminal Procedure Code.
You children will have equal rights over your husband's property as they are both his legal heirs.

A. Hi,
First, you will need to apply for anticipatory bail to the Sessions or High Court. If the complaint is false or malicious, you can make a petition to the High Court to quash the complaint.
If it is a mutual consent divorce, you can negotiate to reach an amount that is more affordable to you. Failing this, the Court determine the alimony on the basis of your ability to pay, so an unreasonable amount will not be granted by them.

as per senior citizens welfare act, daughters also have responsibility on her parents.

A. Dear Sir,
It depends upon Court which issues notices/summons to those persons normally you have an option to get the same and send the same by Registered Post by yourself so that notices are served within next few days.

Your mother can file a case under domestic violence act and claim maintenance. Also, she needs to file an application to the court for legal separation and divorce. The court has the power to give order for interim maintenance as well.
